38mph martyr set to appeal
A painter and decorator from Derbyshire wants to become Britain’s first speed camera martyr. Ernie Harbon was convicted and fined £60 for speeding but refused to pay and was jailed for a week. Now his legal team want to appeal his case.
His solicitor Clive Burton, of the Nottingham law firm Burton & Burton, said: “We are really very keen to take this case to the High Court. We believe we have a very strong case. This is very much a case of a man being denied justice because he does not have enough money to be able to take the risk.”
Last week judges in the European Court of Human Rights ruled the British legal system had denied David Morris and Helen Steel, the McLibel campaigners, a fair trial as they could not afford to pay for a lawyer to represent their case against McDonald’s, the fast food giant. Harbon said he, too, had been unable to afford the cost of pursuing his case through the courts.
“It’s unfair,” said Harbon. “If I had enough money I would definitely like to have another go. I still think I’m in the right. But I’m nearly 64 and the last thing I need is to end up thousands of pounds in debt.”
Harbon was flashed by a speed camera while doing 38mph in a 30mph zone near Codnor, Derbyshire, on January 2, 2003. His legal team claims speed limit signs in the area did not conform to traffic regulations.
Richard Bentley, one of Britain’s leading independent experts on road signage law, who gave evidence at Harbon’s trial, believes he has a good case.
